Please read these terms and conditions carefully before using our services as they contain important information regarding your legal rights, remedies and obligations. With the booking of a lesson and/or a payment, these terms and conditions will be seen as accepted and binding.

1. The use of this website
Welcome to the terms and conditions of the Deutschsprechen.net website operated by Kirsten Winkler.
These terms and conditions set the rights and obligations of Deutschsprechen.net, the users, the registered students and of other third parties.
By confirming that the users and/or the registered students have read these terms and conditions and by continuing to sign up for the services of Deutschsprechen.net they are notifying their acceptance of these terms and conditions and agree that they should be binding in all circumstances and shall be applicable to their use of the service provided by Deutschsprechen.net.
By agreeing to the terms and conditions of the Deutschsprechen.net website, the users and/or the registered students certify that they have an age of 18 years or older and can form legally binding contracts under their applicable law.
If the users and/or registered students do not agree to these terms and conditions, they should immediately cease all usage of the Deutschsprechen.net website.
Deutschsprechen.net reserves the right to modify, alter or update these terms and conditions at any time. Modifications will become effective immediately upon being posted at http://www.deutschsprechen.net/terms.html.

2. The Description of the Service
Deutschsprechen.net provides registered users of this site with online German language lessons through a virtual classroom environement provided by www.wiziq.com and/or a VoIP (Voice over IP) Service, provided by www.skype.com.
The lessons have a duration between 30 minutes and 60 minutes.
The students must provide all the equipment necessary e.g. Personal Computer, Headset, Skype Account, PayPal or Moneybookers Account for the payment and Internet Connection.
The students have to pay for any aditional fees related to their connection to their provider.
3. The Booking of Online Lessons
In order to book a lesson, the students have to open an account at www.scheduly.com.

In order to enter the virtual classroom, the students have to open an account at www.wiziq.com.

After the correct registration at www.scheduly.com the student will be able choose a day and time in the schedule and to book it. The student will get a confirmation Email from www.scheduly.com about the reservation and a second confirmation when the teacher accepted the lesson.
The times indicated in the schedule are in GMT + 01:00. The students have to convert them in his timezone and to make sure, that the time he books is correct. Cancellations because of a wrong time booked cannot be refunded.
The Students must book their online lessons up to twelve hours before the lesson start.
In case a student does not show up to a booked lesson without a prior notice at last 12 hours before the lesson start, no refund, payment or compensation of any kind will be paid by Deutschsprechen.net.
In case a student arrives late, the lesson should finish at the scheduled time. The lost time occurred to a student will be deemed to have been used.
If the teacher does not show up or arrives late, the student will be provided with recredited lesson to compensate that lost for no extra charge.
Regarding technical problems, refer to article 9. Limitation of Warranty of the terms and conditions.
4. Cancellation or Rescheduling of Online Lessons
Lessons can be cancelled or rescheduled by the student with no extra charge if the cancellation or rescheduling is done at latest 48 hours before the start of the lesson.
If a lesson is cancelled or rescheduled at latest 24 hours before the start of the lesson a fee of 50% of the lesson price will be charged.
If a lesson is cancelled or rescheduled at latest 12 hours before the start of the lesson a fee of 75% of the lesson price will be charged.
If a lesson is cancelled or rescheduled less then 12 hours before the start of the lesson the lesson will not be refunded.

5. Personal Information
To use the service of Deutschsprechen.net the students have to open accounts at www.scheduly.com and www.wiziq.com.
These sites will request some personal information such as name, email address, city, country and other relevant information.

Deutschsprechen.net commits to respecting the private life of its students. Deutschsprechen.net commits to not selling, renting, trading or disclosing collected information of its students to any third parties.
The collected information remains confidential. Deutschsprechen.net uses the collected information to answer your queries or complaints, to deliver our service (for example to test your level, to support your learning, to send you exercises), for administrative purposes, to improve our marketing and promotional efforts, to customize our website's content and services. We may use your email address to contact you regarding notices, surveys, new service offerings and communications relevant to your use of our website.

Nevertheless, we may provide time adjustments on request.
Deutschsprechen.net disclaims all warranty regarding the occurrence of the following technical problems:
- The temporary impossibility to connect to the Internet,
- The temporary impossibility to connect to the website or some of its web pages,
- The break in the link between a teacher and a student through the video conferencing platform.
Concerning each of these cases above, Deutschsprechen.net endeavours to do everything possible to restore the running of its service.
10. Limitation of Liability
Deutschsprechen.net excludes all liability and responsibility for any amount or kind of loss or damage to you or a third party, and in particular Deutschsprechen.net should not be liable for any direct, indirect, consequential, or incidental loss or damages, or any loss of income, loss of profits, loss of data, loss of contracts, loss of use, arising from or connected in any way to this website, the information contained in it, and the interruption of service, and whether in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Deutschsprechen.net has been advised of the possibility of such damages.
Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consequential damages, therefore some of the above limitations is inapplicable.
11. Payment and Conditions of Payment
Registered Students can purchase their lessons by PayPal or by credit card through the Deutschsprechen.net website. All prices mentioned are in Euros, tax included.
No payment is asked for the Free needs analysis.
Once the purchase is made, no refund can be paid by Deutschsprechen.net.
For each purchase, the student will receive an invoice by email.
12. Governing Law and Jurisdiction
Deutschsprechen.net is operated and provided in France.
As such, Deutschsprechen.net is subject to the laws of France. Those legal terms and conditions shall be governed by and construed in accordance with the French law.
Disputes arising in connection with those legal terms and conditions shall be subject to the exclusive jurisdiction of the French courts.
